What is Chapter 7 Bankruptcy

Chapter 7 Bankruptcy is designed to provide a fresh start to individuals whose income is insufficient to pay their debts. In a Chapter 7 case, the debtor is permitted to exempt certain property which prevents the debtor from losing their assets.

The US Bankruptcy Code allows the debtor to keep some, or in most instances, all of their personal property. Often, a debtor will continue to make payments on a car loan or a mortgage on their home. This is done by signing a reaffirmation agreement, keeping the same terms and payments on these particular debts.

There are numerous reasons why one may file a Chapter 7 bankruptcy. The most common reasons are loss of income (job), divorce, medical bills and credit card debts.
